The Queensland Civil and Administrative Tribunal (commonly referred to as QCAT) now look after all aspects of administration and guardianship for adults.

Duffy Lawyers can provide you with advice and assistance if you are considering making an application to QCAT for the appointment as an Administrator or Guardian for an adult.

Such an application would arise where an adult needed assistance due to an impairment or lack of capacity to make financial and legal decisions and no Enduring Power of Attorney is in place. Administrators are not allowed to make decisions about personal or health care matters.

A Guardian can be appointed by QCAT to assist adults with impaired decision making capacity by making certain personal and health care decisions on their behalf.

Both applications are a complex paper intensive exercise and it is strongly recommended that you obtain proper advice before proceeding with such an application.
